mso-hansi-theme-font:minor-fareast">监察法第四十五条规定,“对有职务违法行为但情节较轻的公职人员……进行谈话提醒、批评教育、责令检查,或者予以诫勉”,以国家法律的形式规定了“谈话提醒”。党内法规中,已多有“谈话提醒”的规定。如<span lang="EN-US">2016</span>年修订的《中国共产党党内监督条例》(简称党内监督条例)在规定了提醒谈话和诫勉谈话的基础上,第三十一条规定,针对“干部一般性违纪问题的反映,应当及时找本人核实,谈话提醒、约谈函询,让干部把问题讲清楚”。此外,<span lang="EN-US">2017</span>年试行、<span lang="EN-US">2019</span>年修订实施的《中国共产党纪律检查机关监督执纪工作规则》(简称监督执纪规则)在谈话函询后针对问题轻微不需要追究纪律责任的规定,可采取谈话提醒等措施进行线索处置。那么,针对某一情节较轻的职务违法行为,谈话提醒如何与诫勉谈话等措施区分?可否与批评教育、责令检查等措施同时适用?如何与党内规定的提醒谈话等措施区分?本文拟对谈话提醒相关制度的历史沿革予以简要梳理,明确其适用条件,为准确适用提供基础。<span lang="EN-US"><o:p></o:p></span></span></p>

mso-hansi-theme-font:minor-fareast">“谈话提醒”规定的历史沿革。笔者认为,监察法中谈话提醒的规定来源于党内规定。在党内文件中,有关谈话提醒的规定出现得很早,如<span lang="EN-US">1998</span>年中共中央印发的《中国共产党党和国家机关基层组织工作条例》第十八条规定,“对于群众意见较大的党员干部,要及时谈话提醒。”然而,明确要求建立谈话提醒制度的文件应是中共中央国家机关工委同年发布的《关于建立和实行谈话提醒制度的意见》(简称《意见》)。《意见》要求,“谈话提醒的对象,主要是群众反映有违纪苗头和其他需要谈话提醒的党员”,谈话提醒的主要内容包括“涉及到遵守和维护党的政治纪律,贯彻执行党的路线、方针、政策……正确运用权力,勤政廉政……坚持民主集中制原则……以及道德品质、思想工作作风等方面的有关情况”。据此,可以断定,《意见》规定的“谈话提醒”主要针对的是苗头性和一般情况的提醒,并不针对违纪(哪怕是轻微违纪)的情况。<span lang="EN-US">2003</span>年《中国共产党党内监督条例(试行)》中专门明确了谈话制度的内容,第三十条关于“谈话”的规定,与《意见》中谈话提醒的主要内容基本一致。然而,对于苗头性问题则要求进行诫勉谈话,这样一来,等于将《意见》中的谈话提醒细分为一般性谈话和诫勉谈话。<span lang="EN-US"><o:p></o:p></span></span></p>

mso-hansi-theme-font:minor-fareast">“谈话提醒”适用的条件。既然监察法针对情节较轻的职务违法行为,可以采取谈话提醒等四种处置方式,那么从监察法第四十五条规定的立法沿革、目的、逻辑以及同条其他项规定的方式来看,谈话提醒应当与批评教育、责令检查、诫勉谈话具有不同的含义和适用范围。而既然将诫勉谈话作为“有职务违法但情节较轻的”情况下最后一种处置结果,因此笔者认为,与谈话提醒、批评教育、责令检查等相比,诫勉谈话应为是否给予政务处分(相对应党纪处分)的分水岭,即“第一种形态”与“第二种形态”的分水岭。基于此,谈话提醒应适用于情节最为轻缓的职务违法,而批评教育、责令检查介于其和诫勉谈话之间,根据个案情况选择合适处置措施。<span lang="EN-US"><o:p></o:p></span></span></p>

mso-hansi-theme-font:minor-fareast">既然谈话提醒、诫勉谈话等四种措施均适用于“有职务违法但情节较轻的”情形,那么在个案中是择一适用,还是可以合并适用?有观点认为可同时适用于某一职务违法行为。笔者不同意此观点,原因包括:一方面,四种处置措施可否自由组合使用?考虑到这些措施即便在党内规定中也不适合自由合并使用,更不用说上升为国家法律后,上述各措施之间的概念、适用条件应该更为明晰,方可确保制度的有效执行;合并使用则模糊了对某一职务违法行为究竟哪个是有效举措的问题。另一方面,如果谈话提醒、批评教育等措施合并使用,则与监察法第四十五条第一款其他部分的规定不相协调,如第二项规定,“对违法的公职人员……作出警告、记过、记大过……等政务处分决定。”针对某一职务违法行为,原则上只能给予警告、记过等一种政务处分。因此,针对某一情节较轻的职务违法行为,也应选择适用谈话提醒、诫勉谈话等一种措施。<span lang="EN-US"><o:p></o:p></span></span></p>

mso-hansi-theme-font:minor-fareast">“谈话提醒”与“提醒谈话”的区别。在国家监察体制改革的背景下,对监察法相关规定进行理解和分析时,需要回溯规定的党内法规渊源及其发展,方可准确理解其核心要义。在此基础上,根据党内监督条例规定,思想、作风、纪律等方面苗头性、倾向性问题的情况适用提醒谈话,而根据党内监督条例和监察法规定,谈话提醒(以及诫勉谈话)适用于轻微违纪或情节较轻的职务违法,由此,在“提醒谈话(无违纪)——谈话提醒、诫勉谈话等(轻微违纪<span lang="EN-US">/</span>违法)——党纪<span lang="EN-US">/</span>政务处分(违纪<span lang="EN-US">/</span>违法)——触犯刑律”之间划定了各自的适用范围。因此,那种将《纪检监察机关监督执纪“四种形态”统计指标体系(试行)》“第一种形态”指标中只提及提醒谈话而未包括谈话提醒理解为两者是同义的观点似乎是不成立的。否则就很难理解,《中国共产党党内监督条例(试行)》修订时要将原先苗头性问题适用诫勉谈话改为适用提醒谈话,而将诫勉谈话适用于轻微违纪的情况。如此理解谈话提醒,有助于解决因混用所导致的难题,也有助于纪法协调衔接。<span lang="EN-US"><o:p></o:p></span></span></p>

minor-fareast;mso-hansi-font-family:Calibri;mso-hansi-theme-font:minor-latin">适用对象不同。谈话提醒针对“有问题”、需要组织进行提醒的党员干部。实践中,有的同志将廉政谈话作为谈话提醒中的一类方式进行统计,我们认为两者存在区别。从适用对象上来看,廉政谈话一般针对五类人,即拟提拔任用、新提任或转任岗位的领导干部,即将退休的党员干部,在同一岗位任职时间较长的党员干部,在人、财、物权较集中的关键岗位的党员干部,每年由各地各部门负责人进行分期分批约谈所针对的领导班子成员和下级党组织负责人。成为廉政谈话对象往往因为其具有特殊身份或位于特殊岗位,但成为谈话提醒对象则并非基于其身份,而是其在执行“六项纪律”等方面可能或已经出现了问题。</span><span lang="EN-US" style="font-size:14.0pt;mso-bidi-font-size:11.0pt"><o:p></o:p></span></p>
